Kicked out at police officer

After he shouted abuse at police a 48-year-old man kicked out at an officer when he was taken into custody.

Mark Armstrong, Murray Wood, Waringstown, admitted disorderly behaviour, resisting a constable and assaulting a constable on March 23 this year.

The case had been adjourned from a previous sitting of Craigavon Magistrates Court until last Wednesday so that a pre-sentence report could be obtained.

A public prosecutor said that at around 6.30pm in Church Place, Lurgan, police were approached by the defendant who was intoxicated.

He began to shout abuse at them saying ‘you are a f—king c—t and black –b—d’ while making a gesture with his middle finger.

Armstrong refused to move on and was arrested and handcuffed. In custody he struggled with police and kicked out at an officer, hitting him on the leg.

Later he calmed down and when he was charged he apologised for his behaviour.

A barrister representing the defendant said he had taken a lot of drink and had no recollection of what happened.

Deputy District Judge Joe Rice said the pre-sentence report indicated Armstrong would not be suitable for community service.

He added that the report was positive and this was clearly a one off situation.

For each of the three offences he imposed a one month custodial sentence, suspended for three years.
