High Court to review Bleachgreen right-of-way appeal

THE High Court will today review the appeal of a County Court ruling of the Green Road in Ardmore as a public right of way.

A Derry City Council application that the road be declared a public right of way was heard before the County Court Judge in June, with the incumbent declaring the Green Road a public right of way after viewing the thoroughfare.

The judge also granted an injunction against land owners Mr and Mrs Condit ordering them to remove any and all obstructions from the road.

Mr and Mrs Condit subsequently appealed the decision to the High Court, which is due to review the appeal tomorrow with a view to a future hearing.

A report to the Council Environmental Services Committee earlier this month advised: "The High Court will review the appeal on 30th September 2010 with a view to issuing any appropriate pre-hearing directions or orders and, if possible, fix a date for the substantive hearing of the appeal."
